Recommended Motion:
Adopt Proposition 15 and/or Proposition 18 Board Resolutions.
Rationale:

Staff will provide information for the Board to consider regarding the endorsements of Proposition 15, tax on commercial and industrial properties for education and local government funding initiative and/or Proposition 18, primary voting for 17-year-olds amendments on the November 2020 Ballot.

VI.e. Approval and Ratification of Bond Program and Facility Agreements
Recommended Motion:

Approve the following Bond Program or Facility Agreements: 

  1. Facility Funded Piggyback Contract Award- Enviroplex, Inc. for the supply and installation of classroom casework in two rooms at North Davis Elementary School
  2. Bond Funded Construction Management Services- Innovative Construction Services, Inc. Master Contract and Project Authorizations for the Emerson/DVJH Science Classroom Project, the Korematsu Preschool Project, and the District-wide Hydration Station Project
Rationale:

Pursuant to Board Policy 3312 and California Education Code, all contracts and agreements must be approved and ratified by the Board of Education.  The agreements are listed in the attachment section below and apply to the following Bond Program or Facility projects.

  1. Staff is recommending approval of Resolution 28-21 authorizing DJUSD to purchase modular building components (casework) for two classrooms at North Davis Elementary School via the Enviroplex, Inc. January 15, 2018 "Piggyback Bid" with the Willows Unified School District.  Two classrooms at North Davis Elementary School currently do not have sufficient casework to adequately support science instruction.  Staff believes procuring and installing the casework through the Enviorplex Piggyback contract is the most cost effective solution.  This contract would be funded by Facilities funds.
  2. Innovative Construction Services, Inc.– Master Contract for construction management services during pre-construction and construction phases and Project Authorizations for the Emerson/DVJH Science Classroom Project, the Korematsu Preschool Project, and the Hydration Station Project. The 2018 Facilities Master Plan allocated 5% of each project’s construction cost for construction management services. The proposed construction management fees for these projects represent less than 3% of the estimated construction costs.  This contract would be funded by the Bond Program.

Recommended Motion:
Approve and ratify the contracts and agreements as presented.
Rationale:
Pursuant to Board Policy 3312 and California Education Code, all contracts and agreements need to be approved and ratified by the Board of Education.  The current contracts which are being presented to the Board are listed in the attachment section below.  Additional contract(s) may be included prior to the meeting.

VII.a. Opening of School, COVID-19 Response and Learning Continuity and Attendance Plan Updates
Rationale:

Staff will provide an update to the Board of Education regarding the status of plans to serve our students, staff, families and community focused on slowing the spread of COVID-19 in our region, the start of school on August 26, 2020 with a 100% Distance Learning program and the Learning Continuity and Attendance Plan.

VII.b. DJUSD Learning Continuity and Attendance Plan Public Hearing
Recommended Motion:
Hold a public hearing regarding the DJUSD Learning Continuity and Attendance Plan for the 2020-2021 school year. 
Rationale:

Senate Bill (SB) 98 establishes that the Local Control and Accountability Plan (LCAP) and an annual update to the LCAP are not required for the 2020–2021 school year and that the California Department of Education (CDE) shall not publish the California School Dashboard in December 2020 based on performance data on the state and local indicators. SB 98 supersedes the requirement to develop and adopt an LCAP by December 15, 2020, which was established by Executive Order N-56-20, and published in April 2020.

SB 98 also separates the development and adoption of the Budget Overview for Parents from the development and adoption of the LCAP for the 2020–2021 school year. The legislation also requires that the Budget Overview for Parents be developed and adopted by December 15, 2020. The requirements to hold a separate public hearing and adoption at a public local governing board meeting consistent with California Education Code (EC) Section 52064.1 of the Budget Overview for Parents remains.

SB 98 establishes California EC Section 43509 and the Learning Continuity and Attendance Plan (Learning Continuity Plan) requirements for the 2020–2021 school year.

The Learning Continuity Plan (LCP) is intended to balance the needs of all stakeholders, including educators, parents, students, and community members, while both streamlining engagement and condensing several preexisting plans. In particular, it was important to combine (1) the intent behind Executive Order N-56-20, published in April 2020, which envisioned an off cycle Local Control and Accountability Plan (LCAP) due December 15th, and (2) the ongoing need for LEAs to formally plan to return to school in the midst of the uncertainty and of COVID-19, without requiring two plans. The Learning Continuity Plan replaces the LCAP for the 2020–2021 school year.

The Learning Continuity Plan adoption timeline of September 30, 2020 is intended to ensure the Learning Continuity Plan is completed in the beginning of the 2020–2021 school year. Additionally, the timeline is intended to allow for communication of decisions that will guide how instruction will occur during the 2020–2021 school year. This includes in-person instruction, according to health guidance, and distance learning, while providing critical opportunities for stakeholder engagement.

The Learning Continuity Plan template memorializes the planning process already underway for the 2020–2021 school year and includes descriptions of the following: addressing gaps in learning; conducting meaningful stakeholder engagement; maintaining transparency; addressing the needs of unduplicated pupils, students with unique needs, and students experiencing homelessness; providing access to necessary devices and connectivity for distance learning; providing resources and supports to address student and staff mental health and social emotional well-being; and continuing to provide school meals for students.

The content of the Learning Continuity Plan has been presented to the Superintendent's Parent Advisory, District English Learner Advisory, Certificated and Classified Advisory, Special Education Parent Committee, student representatives, Native American Committee, and District Technology Advisory Representatives on August 25, 2020. On the same date, a draft of the plan was shared with all members to include instructions for providing feedback. The final version of the LCP is scheduled for approval by the Davis Joint Unified School District Board of Trustees on September 17, 2020.

VIII. UPDATE ON TENTATIVE BOARD AGENDA CALENDAR
Rationale:

The calendar is a fluid, working document used by the Board President and Superintendent in support of the Board conducting efficient and effective Board meetings. Changes in the date of future agenda items occur frequently to best fit Board items into the time parameters of Board meetings and District priorities.
