The California Environmental Quality Act (CEQA), Public Resources Code Sections 21080 et seq. requires the District, as the project proponent, to comply with certain environmental impact documentation regulations. The required documentation is based on the specific nature of each proposed project.

Title 14 of the California Code of Regulations, Chapter 3, Article 19, provides for categorical exemptions for classes of projects which have been determined not to have a significant effect on the environment and which shall, therefore, be exempt from the provisions of CEQA. Staff, working in conjunction with legal counsel, find the proposed project meets the following categorical exemptions.

Class 2 (Sec. 15302): The proposed project includes the replacement or reconstruction of existing structures. Class 3 (Sec. 15303): The proposed project includes new, small facilities or structures, the conversion of existing small structures, and utility extensions and accessory structures. Class 14 (Sec. 15314): The proposed project would be located within the existing North Davis Elementary campus, a developed property within the City of Davis, and will not increase original student capacity by more than 10 classrooms or 25 percent.  Common Sense Exemption (Sec. 15061(b)(3)): It can be seen with certainty that there is no possibility that the proposed project involves any activity that may have a significant effect on the environment.  District will be improving an already developed property, with low increased capacity.

Per Board Policy 3300, the Clerk of the Board shall review and report to the Board all transactions entered into by the Superintendent or designee on behalf of the Board every 60 days. (Education Code 17605)

Per Board Policy 3314, the Board shall approve all warrants at a regularly scheduled Board meeting.

Approve the following Bond Program or Facility related Agreements:

1.  Construction Contract Form Authorization to Award- John F. Otto, Inc. dba Otto Construction for sitework construction services for the Korematsu Preschool Project (Bond funded).

2. Professional Services Agreement- Wallace-Kuhl and Associates to provide Division of the State Architect required special testing for the Da Vinci Junior High Administration Building Project (Facilities Funded). 

3. Professional Services Agreement- Hancock Park & DeLong, Inc. to provide State School Facility Program Facility Hardship consulting services related to structural repairs for North Davis Elementary School (Facilities Funded). 

Pursuant to Board Policy 3312 and California Education Code, all contracts and agreements must be approved and/or ratified by the Board of Education. The agreements are listed in the attachment section below and apply to the following Bond Program or Facilities projects:

1.  Staff is recommending the Board authorize the Superintendent to execute the attached construction contract form upon DJUSD receiving all required contract exhibits, performance bonds, and insurance. On October 1, 2020, sealed bids were opened for the sitework construction component of the Korematsu Preschool Project.  A total of four bids were received and the low bid was submitted by Otto Construction in the amount of $3,098,000.  The bid amount is consistent with the project budget.  This is a Bond Program funded project.

2.  Staff is recommending the Board approve a Professional Services Agreement with Wallace-Kuhl and Associates for required special materials testing in support of the Da Vinci Junior High School Adminstration Building Project.  This project is funded by Facilities Funds.

3.  Staff is recommending the Board approve a Professional Services Agreement with Hancock Park and DeLong, Inc. to provide consulting services in support of DJUSD preparing and submitting an application for Facilities Hardship funding through the State School Facilities Program for structural repairs at North Davis Elementary School.  If the application is successful, the State would provide 50% of the funding necessary to repair structural deficiencies in two classroom wings at North Davis Elementary School.  Staff has worked with a structural engineer to confirm that deflections in the foundation slab in two classroom wings are not an imminent hazard, but do require repair.  This agreement would be funded by Facilities Funds.

Staff will provide an update to the Board of Education about the progress on steps to return to campus for students and staff.  The presentation will focus on Phase 2 of the DJUSD Phased Return to Campus Plan, which specifically addresses providing in-person services to students with the most urgent needs.

Based on the latest enrollment information, staff will provide the Board and community a 2020-21 enrollment update. The numbers reflect students rolling up from one grade to the next, new transitional kindergarten/kindergarten enrollment, overflow placements, intra-district or new inter-district requests.  Staff will also provide information on declining enrollment in the District  and its probable causes related to COVID-19.

Following the passage of Assembly Bill 2016, which initiated the development of an Ethnic Studies Model Curriculum, the state of California explored Ethnic Studies as a program requirement for all of the state's school districts. Although AB 331, which would have mandated the graduation requirement, was vetoed in August, 2020, the state continues to review an Ethnic Studies model curriculum to support districts that plan to proceed with local Ethnic Studies programming.

DJUSD plans to reconvene an Ethnic Studies Task Force, which was paused during COVID-19 school closures, to support piloting, development, and ultimately a program recommendation for adoption. The process for this work for the 2020-21 school year will be student-centered and teacher-guided in an effort to support educational experiences for all that are relevant, meaningful, and affirming of student identities across diverse ethnic communities.
