VI.d. Approve Adult Education Program Courses for 2020-2021
Recommended Motion:
Approve the 2020-2021 Adult Education program as proposed.
Rationale:

The Board of Education recognizes that education is a lifelong process and that it is important for individuals to continuously develop new skills.

The Superintendent or designee shall develop and oversee the Dstrict's adult education program.  The Board shall approve all courses to be offered in this program.

The California State Department of Education requires the local governing Board to approve the adult education classes to be offered in the District. Such approval must be made at a public meeting in accordance with Education Code Section 35145. The course approval list can be adjusted throughout the year through CDE. Enclosed in this Board packet attachment is a list of adult education courses expected to be offered throughout the 2020-2021 school year. Classes can be added or deleted depending on community response and teacher availability.

Additionally, the Davis Adult and Community Education (hereafter referred to as DACE) is a member of the Capital Adult Education Regional Consortium (CAERC) which requires all member districts to approve the annual consortium Memorandum of Understanding that governs how state allocations are distributed and membership responsibilities.  This is a requirement of AB 104 which specifies how adult education funding is distributed throughout the state.  This will be the sixth year of membership in the Capital Adult Education Consortium.  Consortium boundaries are determined by community college district boundaries.  Davis is in the Los Rios Community College District.

DACE operates classes on the quarter system, coordinating with both the DJUSD and UC Davis calendars. State-approved programs (High School Diploma, ESL, Parent-Child K12 Success, Workforce Readiness, and CTE) operate year-long.  Parent Education (Davis Parent Nursery School) operates on the traditional DJUSD calendar.  The Adult School calendar for the 2020-21 school year is as follows:

DACE is closed during all school district holidays.

During normal operations, DACE office hours during the 2020–2021 school year will be Monday through Thursday, 10:00 a.m. – 1:00 p.m. and 2:00 p.m. – 7:00 p.m. With the exception of holidays, we will be open to the public 32 hours per week.

Special Conditions During School Closures due to COVID 19

COVID 19 and the resulting school closures present a series of challenges for the Adult School and require us to think differently about how we operate.

DACE will offer a small number of virtual fee-based classes during the Fall quarter and will re-evaluate the feasibility of returning to in-person classes in future quarters in alignment with DJUSD and Yolo County policies and recommendations.

All state-supported programs will be conducted virtually for the foreseeable future, but may include in person instructional options once it is deemed safe to do so and in accordance with DJUSD policies and recommendations.

Davis Parent Nursery School (DPNS) has decided not to operate its programs as long as in person instruction is not possible.   If and when schools are able to reopen in person instruction, DPNS will re-evaluate the feasibility of their program based on enrollment.  DPNS is a self-funded program which relies entirely on student fees to pay their teachers and to fund operational expenses.

The DACE office in accordance with other front offices in the district will be open Mondays, Wednesdays, and Fridays from 1:00 pm to 5:00 pm for a total of 12 hours with no more than one person working in the office at any one time and all staff employing appropriate PPE when on campus and when dealing with the public.

VI.e. Approve Capital Adult Education Regional Consortium Memorandum of Understanding
Recommended Motion:

Approve the Memorandum of Understanding between Davis Joint Unified School District and Capital Adult Education Regional Consortium effective July 1, 2020- June 30, 2023.

Rationale:
The Davis Adult and Community Education is a member of the Capital Adult Education Regional Consortium, which requires all member districts to approve the annual consortium MOU. This MOU documents the relationship and articulates roles and responsibilities between the Capital Adult Education Regional Consortium (CAERC) fiscal agent, Sacramento County Office of Education, and DJUSD. The term of this agreement is from July 1, 2020 through June 30, 2023.
 
Financial Impact:
Any expenses associated with this agreement are included in the approved budget.

Recommended Motion:

Accept the proposed Board Policy amendments as a first reading, waive the second reading, and approve the revised Board Policies as presented. 

Rationale:

CSBA, through its Board Policy service, prepares comprehensive updates to insure compliance with statutory changes and/or provide clarity to existing policies.  By following CSBA guidelines, the District's Policies, Procedures and Bylaws incorporate the most up to date local/federal mandates and laws.  The Board Policies and Bylaws listed below have been reviewed by the Board Policy Subcommittee, staff, and Superintendent and are recommended for Board approval.

VI.h. Approval and Ratification of Bond Program and Facility Agreements
Recommended Motion:

Approve the following Bond Program or Facility related Agreements: 

  1. Lease-Leaseback (L/LB) Preconstruction and Construction Contract Award- Landmark Construction for Pre-construction and Construction services for the Birch Lane (BLE) Multipurpose Room (MPR) Project. Adopt Resolution 29-21 and approve Site Lease and Facilities Lease.

  2. Construction Management (CM) Services Agreement with Van Pelt Construction Services, Inc. including Project Authorizations for construction management services for the Cesar Chavez (CCE), North Davis (NDE), and Willett (WIL) Elementary School Multipurpose Room Projects.

  3. Architectural and Engineering Services with Lionakis Architects amending the contract for the DaVinci Charter High School (DVHS) Tech Hub Project.

  4. Low Voltage Consulting Services withKMM Services, Inc.  for Bond Program Low Voltage consulting services.

  5. Commissioning Services with LP Consulting Engineers for the DaVinci Charter High School Tech Hub Project.

  6. Solar Master Plan Community Outreach Amendment with ARC Alternatives to support community outreach efforts regarding the placement of solar panels at DJUSD sites.

Rationale:

Pursuant to Board Policy 3312 and California Education Code, contracts and agreements must be approved and ratified by the Board of Education.  The agreements are listed in the attachment section below and apply to the following Bond Program or Facility projects.


1. Lease-Leaseback Preconstruction and Construction Contract Award- Landmark Construction

In accordance with Education Code Section 17406, et seq., the DJUSD Board selected the Lease-Leaseback Project Delivery Method for the Birch Lane Elementary School Multipurpose Room Project at its September 19, 2019 meeting.  The Board adopted a Best Value Methodology for evaluating proposals received in response to its Request for Qualifications and Proposals (“RFQ/P”) for the Projects, and engaged in Lease-Leaseback procurement by issuing the RFQ/P for the first project at Birch Lane Elementary School.

The District subsequently received twelve (12) proposals for the Birch Lane Multipurpose Room Project, evaluated them in accordance with the adopted Best Value Methodology, and made written findings via a Board-approved Resolution and identified Landmark Construction as the Best Value for the Project.

After consideration of all proposals, and in accordance with the adopted Best Value Methodology and taking into consideration the proposers’ demonstrated competence and professional qualifications, the final Lease-Leaseback Agreements for Landmark Construction are presented for approval.  The Lease-Leaseback Agreements recommended for approval are included with this item. 

They are:

a.  Site Lease, including Exhibits A and B; and

b.  Facilities Lease, including Exhibits A-G.

Construction legal counsel, DWK, provided the form of Site Lease and form of Facilities Lease used to negotiate the final agreements. 

The cost for Pre-Construction Services is $15,542.  As contemplated by Education Code, the Facilities Lease shall be amended at a later time to insert the final negotiated Guaranteed Maximum Price after the Project’s plans and specifications are approved by the Division of State Architect.


2. Construction Management Services Agreement- Van Pelt Construction Services, Inc. 

At the April 2, 2020 meeting, the Board approved a Master Contract for construction management services and also approved a Project Authorization for services during pre-construction and construction phases for the Birch Lane Elementary School Multipurpose Room Project. 

Staff is recommending the Board approve Project Authorizations for Van Pelt Construction Services for the other three Multipurpose Room Projects (CCE, NDE, WIL).

The 2018 Facilities Master Plan allocated 5% of each project’s construction cost for construction management services.  The proposed construction management fees for all three additional sites combined are $1,339,245, which represents approximately 4.6% of the estimated construction cost (in 2021 dollars) for the three Multipurpose Room Projects.


3.  Architectural and Engineering (A/E) Services- Lionakis Architects 

On October 3, 2019, the Board approved an architect contract for Lionakis Architects for the design of the DaVinci High School Charter Academy Tech Hub Project.  Subsequent to the initial architect agreement, the DJUSD requested Lionakis provide a design that includes the facilities to be funded by the State CTE grant which will add $3 million to the project.  Approximately $900,000 in additional budget was also added to the construction budget.  Staff is recommending the Board approve the attached amendment to Lionakis's original agreement to accommodate the design of the CTE portion of the Tech Hub and the increased construction budget.  The proposed fee represents 8% of the additional construction budget.  The 2018 Facilities Master Plan allocated 10% of each project’s construction cost for architect and engineering design fees. 


4.  Low Voltage Consulting Services- KMM Services, Inc. 

KMM Services Inc. has provided low voltage systems design and peer review services for the Bond Program for the last two years.  Low voltage systems include data systems, fire and intrusion alarm systems, video systems, phone systems, and clock, bell, and speaker systems.  Staff is recommending continuing these services for the 2020-2021 fiscal year.


5.  Commissioning Services- LP Consulting Engineers 

The Division of the State Architect requires the commissioning of mechanical systems on new school construction projects.  Staff is recommending the Board approve the attached proposal from LP Engineers, Inc.  for the commissioning of the DaVinci High School Tech Hub Project.


6. Solar Master Plan Community Outreach Amendment- ARC Alternatives 

On February 6, 2020, the Board approved a contract with ARC Alternatives to identify capacity and proposed locations for solar panels at each DJUSD site and to provide an associated feasibility analysis.  Staff is recommending the Board approve the attached amendment to ARC's original agreement for the purposes of having ARC Alternatives provide support for the community outreach portion of determining solar placement at each site.  ARC Alternatives has provided superior services in fulfilling their original contract scope.  The proposed addendum fee is $17,079 and would be funded by Facility Funds (not Bond Program funds).

VII.b. Approve the DJUSD Learning Continuity and Attendance Plan
Recommended Motion:
Approve the Davis Joint Unified School District Learning Continuity and Attendance Plan for the 2020-21 school year. 
Rationale:

Senate Bill (SB) 98 establishes that the Local Control and Accountability Plan (LCAP) and an annual update to the LCAP are not required for the 2020–2021 school year and that the California Department of Education (CDE) shall not publish the California School Dashboard in December 2020 based on performance data on the state and local indicators. SB 98 supersedes the requirement to develop and adopt an LCAP by December 15, 2020, which was established by Executive Order N-56-20, and published in April 2020.

SB 98 also separates the development and adoption of the Budget Overview for Parents from the development and adoption of the LCAP for the 2020–2021 school year. The legislation also requires that the Budget Overview for Parents be developed and adopted by December 15, 2020. The requirements to hold a separate public hearing and adoption at a public local governing board meeting consistent with California Education Code (EC) Section 52064.1 of the Budget Overview for Parents remains.

SB 98 establishes California EC Section 43509 and the Learning Continuity and Attendance Plan (Learning Continuity Plan) requirements for the 2020–2021 school year.

The Learning Continuity Plan (LCP) is intended to balance the needs of all stakeholders, including educators, parents, students, and community members, while both streamlining engagement and condensing several preexisting plans. In particular, it was important to combine (1) the intent behind Executive Order N-56-20, published in April 2020, which envisioned an off cycle Local Control and Accountability Plan (LCAP) due December 15th, and (2) the ongoing need for LEAs to formally plan to return to school in the midst of the uncertainty and of COVID-19, without requiring two plans. The Learning Continuity Plan replaces the LCAP for the 2020–2021 school year.

The Learning Continuity Plan adoption timeline of September 30, 2020 is intended to ensure the Learning Continuity Plan is completed in the beginning of the 2020–2021 school year. Additionally, the timeline is intended to allow for communication of decisions that will guide how instruction will occur during the 2020–2021 school year. This includes in-person instruction, according to health guidance, and distance learning, while providing critical opportunities for stakeholder engagement.

The Learning Continuity Plan template memorializes the planning process already underway for the 2020–2021 school year and includes descriptions of the following: addressing gaps in learning; conducting meaningful stakeholder engagement; maintaining transparency; addressing the needs of unduplicated pupils, students with unique needs, and students experiencing homelessness; providing access to necessary devices and connectivity for distance learning; providing resources and supports to address student and staff mental health and social emotional well-being; and continuing to provide school meals for students.

The content of the Learning Continuity Plan has been presented to the Superintendent's Parent Advisory, District English Learner Advisory, Certificated and Classified Advisory, Special Education Parent Committee, student representatives, Native American Committee, and District Technology Advisory Representatives on August 25, 2020. On the same date, a draft of the plan was shared with all members to include instructions for providing feedback.

The public hearing for the LCP was held on September 3, 2020. Revisions include additional stakeholder outreach and plans for Career Technical Education (CTE) and site funding toward MTSS structures.

Approve the Da Vinci Charter Academy Learning Continuity and Attendance Plan for the 2020-2021 school year.

The Learning Continuity Plan template memorializes the planning process already underway for the 2020–2021 school year and includes descriptions of the following: addressing gaps in learning; conducting meaningful stakeholder engagement; maintaining transparency; addressing the needs of unduplicated pupils, students with unique needs, and students experiencing homelessness; providing access to necessary devices and connectivity for distance learning; providing resources and supports to address student and staff mental health and social emotional well-being; and continuing to provide school meals for students.

The content of the Learning Continuity Plan has been included in the DJUSD LCP presented to the Superintendent's Parent Advisory, District English Learner Advisory, Certificated and Classified Advisory, Special Education Parent Committee, student representatives, Native American Committee, and District Technology Advisory Representatives on August 25, 2020.  The content was also shared with the Da Vinci Charter Academy Advisory Board on July 1, 2020 and August 19, 2020.

The public hearing for the LCP was presented September 3, 2020. Revisions include stakeholder outreach and plans for Career Technical Education (CTE).

VII.d. DJUSD Bond Program Update
Recommended Motion:

Receive an update from staff regarding the DJUSD Bond Program. 


Rationale:
In June 2018, the DJUSD Board of Education approved a comprehensive Facilities Master Plan, which outlined the facilities’ needs of the District. In November 2018, voters approved Measure M, a $150 million facilities bond to fund much of the DJUSD Facilities Master Plan. In addition, another $76 million from other sources makes up the DJUSD Bond Program. Staff will provide the Board of Education with an update on the projects currently underway.

VIII. UPDATE ON TENTATIVE BOARD AGENDA CALENDAR
Rationale:

The calendar is a fluid, working document used by the Board President and Superintendent in support of the Board conducting efficient and effective Board meetings. Changes in the date of future agenda items occur frequently to best fit Board items into the time parameters of Board meetings and District priorities.

Quick Summary / Abstract:
The next meeting of the Board of Education is scheduled for October 1, 2020. Consistent with the Shelter in Place orders from the Governor and Yolo County, this meeting is compliant with the Governor’s Executive Order N-29-20 which allows for a deviation of teleconference rules required by the Brown Act. The Board will convene in open session, and immediately thereafter adjourn to closed session at 5:00 p.m. The Board will reconvene in open session at approximately 6:30 p.m. In person attendance will not be permitted.
