Quick Summary / Abstract:

In the interest of conducting the business of public education in a timely manner, there is a two or three-minute limit per individual speaker which, at the discretion of the board president, may be modified depending on the number of speakers.  A maximum of thirty (30) minutes for the comment period may be imposed.

In order to maintain a respectful public forum, members of the audience will please limit applause to occasions of student performance, employee recognition, and significant community contributions which are celebrated by everyone present.

During this public comment period, the law does not allow the Board of Education to take action on any item not explicitly posted on the agenda in advance.  However, Board members may ask for clarification, refer concerns to staff, and/or request that an item be placed on a future agenda.

Recommended Motion:

Approve submission of the Request for Allowance of Attendance Due to Emergency Conditions (Form J-13A) for Fairfield Elementary School to the California Department of Education.


Rationale:

On October 8, 2019, Davis Joint Unified School District received notice that power would be turned off at Fairfield Elementary School due to extreme high winds. 

Due to the complete power outage, all classes at Fairfield Elementary School were cancelled for October 9, 2019. The weather forecast predicted high winds to continue though October 10; staff developed a plan for students to attend Patwin Elementary School on October 10. 

 


 
Financial Impact:

Once Form J-13A, Request for Allowance of Attendance due to Emergency Conditions, is submitted and approved by CDE, YCOE is authorized to disregard the closure day in the computation of average daily attendance per Education Code Section 41422 and obtain credit for instructional time for the day and the instructional minutes that would have been regularly offered on the closure day.

Rationale:

Pursuant to Board Policy 3312 and California Education Code, all contacts and agreements need to be approved and ratified by the Board of Education.  The current agreement(s) are listed in the attachment section below and apply to the following Bond Program projects:

VII. PRESENTATION/DISCUSSION/ACTION
VII.a. Study Session- Paths to District Sustainability and Security
Recommended Motion:
Receive a presentation regarding paths to District sustainability and security and to possibly provide direction to staff regarding recommended action.

Rationale:

As the Bond program is now underway District staff are planning for improved sustainability aspects for new construction and existing systems and processes. The Board will hear an update from staff regarding various standards, building codes and existing DJUSD policies and practices which promote environmental sustainability. The Board will also receive a presentation from staff regarding the Strategic Fencing and Electronic Lock projects included in the Facilities Master Plan (FMP). The presentation will include a review of activities and events which led to the inclusion of Strategic Fencing and Electronic Locks in the FMP, related policies and practices and more clearly defined project objectives. The Board may provide direction to staff regarding staff recommendations.

VII.b. Public Hearing and Selection of Trustee Area Map
Recommended Motion:

Consider public input and Board approval of a final Trustee area map prepared by the District demographer and vetted by the public at community forums held on October 7, 2019, October 8, 2019 and at School Governance Night on October 28, 2019.







Rationale:

At the Board meeting of May 16, 2019, the Board adopted Resolution No. 41-19 directing the Superintendent or his designee, among other things, to initiate the process of changing the method of electing members of the Board, from the current at-large system whereby each member of the Board is elected by the registered voters of the entire District (Education Code section 5030(a)), to a method which provides that Board members residing in each Trustee area will be elected by the registered voters of that particular Trustee area (Education Code 5030(b)), in sufficient time for the new method of electing members of the Board to be in place for the November 2020 election.

Elections Code section 10010(a)(1) requires the District to hold at least two public hearings to invite community input regarding the composition of the Trustee areas over a period not to exceed 30 days. “Composition of the Trustee areas” includes factors such as visible natural and man-made geographical and topographical features, communities of interest, jurisdictional boundaries and population growth.  The District held these hearings on September 5, 2019 and September 19, 2019.

Elections Code section 10010(a)(1) encourages political subdivisions to conduct outreach to the public, including to non-English-speaking communities, to explain the districting process and to encourage public participation. The District accomplished this at recent community forums held on October 7, 2019, 6:00 p.m., at Da Vinci Charter Academy; and October 8, 2019, 6:00 p.m., at Davis Senior High School, at the District English Learner Advisory Committee meeting on October 22, 2019 at the District Office at 6:00 p.m., and at School Governance Night on October 28, 2019 at Harper Junior High School at 6:00 p.m.

To further encourage public participation, the District has reached out to the public via social media and added a link to its webpage regarding the transition process. Updates and resources regarding the transition process as well as draft maps are posted on the District website.

By law, the District must conduct a minimum of two (2) public hearings on the Trustee area map plan scenarios prepared by its demographer before the Board may select a final plan. Public hearings were held at the District Board Meetings held on October 17, 2019 and November 7, 2019.  Tonight is the third such public hearing.

The Board will invite public comment and input on the draft map scenarios that have been prepared by the District demographer based upon input from the Board and the community.  Following the public hearing, the Board may choose to adopt a Trustee area map, or alternatively, opt to conduct a subsequent public hearing at a subsequent Board meeting to provide further input before making a final map selection with its accompanying sequencing of the Trustee area elections that will begin with the conduct of the 2020 governing Board election in November of 2020.

VII.c. Public Hearing and Approval Regarding Request for Election Waiver to Implement By-Trustee Area Election
Recommended Motion:

Conduct a public hearing to consider public input regarding the waiver request and adopt Resolution No. 39-20 authorizing the submittal of a waiver request to the State Board of Education seeking to waive the election requirement to implement voting districts in the Davis Joint Unified School District.




Rationale:

At the Board meeting of May 16, 2019, the Board adopted Resolution No. 41-19 directing the Superintendent or his designee, among other things, to initiate the process of changing the method of electing members of the Board, from the current at-large system whereby each member of the Board is elected by the registered voters of the entire District (Education Code section 5030(a)), to a method which provides that Board members residing in each trustee area will be elected by the registered voters of that particular trustee area (Education Code 5030(b)), in sufficient time for the new method of electing members of the Board to be in place for the November 2020 election.

When a school district changes its method of election, the Education Code provides that the matter is then voted upon by the electorate at a subsequent election. However, this election requirement may be waived by the State Board of Education. The waiver allows the District to avoid the expense and uncertain outcome of an election on the matter enabling the District to enact its by-trustee area method of election in time for the next general election cycle, thereby avoiding potential liability under the California Voting Rights Act.

As a part of the waiver process, the District is required to notify its collective bargaining units and all committees and councils that have an interest in the subject matter of the waiver and must conduct this public hearing to receive comments from the public.  The District has reached out to these groups for their feedback and is now prepared to conduct the public hearing on the matter.

After the public hearing concludes, the board will vote on adopting a resolution to authorize the submittal of a waiver application to the State Board of Education to allow the District to implement its by-trustee area election method during the next general election cycle

VIII. UPDATE ON TENTATIVE BOARD AGENDA CALENDAR
Rationale:

The calendar is a fluid, working document used by the Board President and Superintendent in support of the Board conducting efficient and effective Board meetings. Changes in the date of future agenda items occur frequently to best fit Board items into the time parameters of Board meetings and District priorities.  

 
VIII.a. Announcement of Annual Organization Meeting on December 19, 2019
Recommended Motion:

The purpose of this item is to set the Board of Education's Annual Organization Meeting on December 19, 2019 at 6:30 p.m.                         





Rationale:

Under the provisions of Education Code section 35143 and Board Bylaw 9100, the governing board is required to set the day and time of its annual organization meeting at its regular meeting held immediately prior to the first Friday in December; that meeting falls on November 21, 2019.   The annual organization meeting shall be conducted within a 15-day period beginning with the same first Friday in December (December 6-21, 2019).  This year's annual organization meeting will be held on December 19, 2019.
