In the interest of conducting the business of public education in a timely manner, there is a two or three-minute limit per individual speaker which, at the discretion of the board president, may be modified depending on the number of speakers. A maximum of thirty (30) minutes for the comment period may be imposed. In order to maintain a respectful public forum, members of the audience will please limit applause to occasions of student performance, employee recognition, and significant community contributions which are celebrated by everyone present.

The Yolo County Governance of Special Education specifies that the Davis Board of Education appoint representatives to the Yolo County Community Advisory Committee. The appointments are for a duration of two years. After discussion and recruitment with the Superintendent's Advisory Committee on Special Education and the special education teachers of the District, two Davis community members are willing to commit to representing the District on CAC. The candidates are knowledgeable about special education programs and services, and can speak to a variety of issues and needs. |

Approve the Memorandum of Understanding between DJUSD and Capital Adult Education Regional Consortium effective July 1, 2019- June 30, 2022.

The Davis Adult and Community Education is a member of the Capital Adult Education Regional Consortium, which requires all member districts to approve the annual consortium MOU. This MOU documents the relationship and articulates roles and responsibilities between the Capital Adult Education Regional Consortium (CAERC) fiscal agent, Sacramento County Office of Education, and DJUSD. The term of this agreement is from July 1, 2019 through June 30, 2022.

The Board of Education recognizes that education is a lifelong process and that it is important for individuals to continuously develop new skills. The Superintendent or designee shall develop and oversee the district's adult education program. The Board shall approve all courses to be offered in this program. The California State Department of Education requires the local governing board to approve the adult education classes to be offered in the district. Such approval must be made at a public meeting in accordance with Education Code Section 35145. The course approval list can be adjusted throughout the year through CDE. Enclosed in this Board packet attachment is a list of adult education courses expected to be offered throughout the 2019-2020 school year. Classes can be added or deleted depending on community response and teacher availability. Additionally, the Davis Adult and Community Education is a member of the Capital Adult Education Regional Consortium which requires all member districts to approve the annual consortium Memorandum of Understanding that governs how state allocations are distributed and membership responsibilities. This is a requirement of AB 104 which specifies how adult education funding is distributed throughout the state. This will be the fifth year of membership in the Capital Adult Education Consortium. Consortium boundaries are determined by community college district boundaries. Davis is in the Los Rios Community College District. Davis Adult and Community Education operates classes on the quarter system, coordinating with both the DJUSD and UC Davis calendars. State-approved programs (High School Diploma, ESL, and CTE) operate year-long. Parent Education (Davis Parent Nursery School) operates on the traditional DJUSD calendar. Davis Adult and Community Education is closed during all school district holidays. Davis Adult and Community Education office hours during the 2019–2020 school year will be Monday through Thursday, 10:00 a.m. – 1:00 p.m. and 2:00 p.m. – 7:00 p.m. With the exception of holidays, we will be open to the public 32 hours per week.

The lease/leaseback construction delivery method is a preferred construction delivery method for large projects in Davis Joint Unified School District. This delivery method is expressly authorized by Government Code section 14706. District counsel Dannis Woliver Kelley has provided all documentation regarding Resolutions 27-20 and 28-20. Prior to soliciting proposals from contractors, the District shall implement the following procedures. Contractor Prequalification Approval of Resolution 27-20 will begin the implementation of a prequalification process to select a contractor(s) for the Birch Lane and César Chávez Elementary School Multipurpose Room projects. Public Contract Code section 20111.6 requires the Governing Board of the District to prequalify bidders for public works projects using any funds from any school bond for a public project with a projected expenditure of one million dollars ($1,000,000.) or more. The California Legislature subsequently amended Public Contract Code section 20111.6 and Education Code section 17406, effective January 1, 2016, to provide that, with respect to public projects completed using the lease/leaseback construction delivery method, the prequalification process required by Public Contract Code section 20111.6 shall apply regardless of the source of funds used to pay for the projects. Best Value Procedures and Guidelines Approval of Resolution 28-20 adopts best value procedures and guidelines as required by Education Code section 17406. Education Code section 17406, requires the District to award lease/leaseback projects based on a competitive solicitation process to the proposer providing the best value to the district, taking into consideration the proposer’s demonstrated competence and professional qualifications necessary for the satisfactory performance of the services required. Before awarding a Facilities Lease and Site Lease for a lease/leaseback project, the district must adopt and publish required procedures and guidelines (“Best Value Procedures”) for evaluating the qualifications of proposers that ensure the best value selections by the district are conducted in a fair and impartial manner.

With the approval of the following items the Board of Education is approving the schematic design and documents required to begin the design development and procurement phase of this project. Design Schematic
The Emerson/Da Vinci Charter Academy Junior High School NextGen Science classroom project was included in the DJUSD Facilities Master Plan (FMP) which was approved on June 14, 2018. The FMP includes up to $6.6 million dedicated to the creation of NextGen science classrooms at Emerson/Da Vinci. The District engaged HY Architects of Davis, CA to design the project schematics. HY Architects, in concert with District staff, conducted significant stakeholder outreach with Emerson/Da Vinci site staff, science staff, administration, and the parent community. All of these stakeholders have reviewed the schematics provided in this agenda item and provided their feedback. Staff believes the design schematics reflect the Next Generation Science Standards and are in alignment with both the FMP and the needs of site staff.
Piggyback Contract
Approval of Resolution 26-20 authorizes the DJUSD to purchase buildings for this project via the American Modular Systems, Inc. August 25, 2018 "Piggyback Bid" with Reef-Sunset Unified School District.
A specific price quotation for the buildings will be provided by American Modular Systems, Inc. in October 2019. A separate construction contract item for the modular buildings will be brought to the November 7, 2019 meeting for Board consideration.
Non-Disclosure Agreement
American Modular Systems, Inc. requires clients to execute a Non-Disclosure Agreement to help protect its proprietary technical and intellectual property. A similar agreement was executed for the North Davis Elementary School American Modular Systems, Inc. project constructed in 2015.

Consider public input regarding the composition of the Trustee areas prior to drawing draft maps of the proposed boundaries of the Trustee areas.

At the Board meeting of May 16, 2019, the Board adopted Resolution No. 41-19 directing the Superintendent and/or his designee, among other things, to initiate the process of changing the method of electing members of the Board, from the current at-large system whereby each member of the Board is elected by the registered voters of the entire District (Education Code section 5030(a)), to a method which provides that Board members residing in each Trustee area will be elected by the registered voters of that particular Trustee area (Education Code 5030(b)), in sufficient time for the new method of electing members of the Board to be in place for the November 2020 election. Elections Code section 10010(a)(1) requires the District to hold at least two public hearings to invite community input regarding the composition of the Trustee areas over a period not to exceed 30 days. The first public hearing was held on September 5, 2019. “Composition of the Trustee areas” includes factors such as visible natural and man-made geographical and topographical features, communities of interest, jurisdictional boundaries and population growth. Elections Code section 10010(a)(1) encourages political subdivisions to conduct outreach to the public, including to non-English-speaking communities, to explain the redistricting process and to encourage public participation. As such, the District has made notices regarding the process available in Spanish. To encourage public participation, the District has reached out to the public via social media and added a link to its website regarding the transition process. Updates and resources regarding the transition process will be posted on District social media and/or the website. After the public hearings are held, draft maps of the trustee areas may be drawn for consideration by the public and the Board.

After discussing the compensation gap, it’s causes, and potential solutions at several Board meetings over the past year, the Trustees provided direction to staff on September 5, 2019 to bring forward a draft Parcel Tax for Employee Compensation Resolution. Staff has created a draft resolution for Board review and discussion. More information regarding a Parcel Tax for Employee Compensation can be on the District’s Website.
